REGISTER OF ECONOMIC SUBJECTS
Although they have different names and functions, in practice their functions are often misunderstood or not interpreted correctly. The following article briefly describes the purpose and functions of both above registers, as well as how subjects can be registered.
REGISTER OF PUBLIC SECTOR PARTNERS
The Register of Public Sector Partners is a public register operated by the Ministry of Justice. The registering body is District Court of Žilina. In this register, public sector partners are registered. Public sector partners are both natural and legal persons who – in simple terms – enter into contractual relations and receive services or finance from public administration entities. If the public sector partner meets the definition of Act no. 315/2016 Coll. on the Register of Public Sector Partners, he is obliged to be registered in the Register of Public Sector Partners, and he has this obligation for the entire duration of the contract based on which this obligation arose.
The main purpose of the Register of Public Sector Partners is to identify the final user of benefits of the registered public sector partner. The final user of the benefits is the natural person who controls or exercises control over the public sector partner, or the natural person for whose benefit the transaction or activity is carried out. The register of Public Sector Partners therefore contains data on the public sector partner, its final user benefits, as well as data on Slovak public officials participating in the governing bodies of the public sector partner or in its ownership structure.
Registration in the Register of Public Sector Partners can only be performed by an authorized person, which may be a lawyer, notary, auditor, bank or tax advisor. The authorized person is obliged to objectively and independently identify the final user of the benefits and is also responsible for this identification.
Who has the obligation to register in the Register of Public Sector Partners provides Act. 315/2016 Coll. on the Register of Public Sector Partners.
REGISTER OF ECONOMIC SUBJECTS
The Register of economic subjects is a public register maintained by the Office for Public Procurement (Úrad pre verejné obstarávanie).
Its purpose is to simplify the procedure for economic subjects to participate in public procurement. The list is voluntary. On the basis of the application, everyone who meets the conditions of personal status according to Act no. 343/2015 Coll. on Public Procurement (has not been convicted of a criminal offense on public procurement, has no arrears on health and social insurance, has no tax arrears, has not been declared bankrupt, restructured, is not in liquidation, has not been banned from participating in public procurement, etc.) is registered.
An entity that is in this register does not have to re-prove its personal status conditions if it wants to participate in the public procurement. Registration in this register is not mandatory, but it significantly speeds up the preparation of documents for applicants in public procurement.
Registration in the register is effective against each contracting authority and the information contained therein does not need to be verified in the procurement procedures.
